FAQ Expression of Interest “Two-year extraordinary and routine maintenance service of air conditioning and ventilation systems of Fondazione IDIS – Città della Scienza”.

Question 1

With reference to the letter of invitation referred to in the subject, we ask whether to demonstrate the requirements of economic and financial capacity referred to in the statement below may be congruous only the presentation of ‘SOA certificate cat. OG11 cl. III.

12. Declares, with reference to the economic and financial capacity requirements requested by the Letter of Invitation, that it has made in the three-year period prior to the date of publication of the tender notice a minimum annual global turnover in the amount of not less than XXXXXXX
It undertakes to produce on request of the Contracting Authority the relevant certificate from the commissioning Body/Company.

13. Declares with reference to the economic-financial capacity requirements of the Letter of Invitation: that the firm has performed, in the three years prior to the date of publication of the tender, in a workmanlike manner and with good results, for a contracting entity/private entity, work similar to that contracted for a total amount of not less than XXXXXX

Answer

In view of the fact that this is a contract involving services and with a works component, Article 86 paragraph 4 of Legislative Decree 50/2016 applies.

Question 2

With reference to the negotiated procedure in question, we ask whether the Self-Certification of Moral Suitability (All. 3) required in point A.2 of the Letter of Invitation, should also be issued by the person who has ceased to hold office, given that the Legal Representative, in point 5) of All. 2, makes the declarations covered in All. 3 on behalf of the same ceased to hold office.

Likewise, in the same All. 3, in the list of persons eligible to make the statement (“in the capacity of”), the words “terminated from office” are not indicated.

Answer

WHEREAS, the contracting station may at any time ascertain the truthfulness of the statements made by the competitors, even by directly accessing the records at the depository bodies, with reference to the question posed, it is not necessary (that the statements of moral fitness be issued also by the persons who have ceased to hold office) to the extent that the current office holder has actual knowledge of the status, intended to be relevant for the purposes of this, of the persons who have ceased to hold office
