Questions no. 1 and no. 2: With reference to the hourly rate for reception and assistance activities to the school public (specifically Science Communicator/Bit Operator, Planetarium Attendant, Facility Maintenance and pre-recorded shows and Reception, Planning and Assistance Service to the booked school public) set as the basis of the tender of € 11.50, it is noted that this rate, to be lowered, is not congruous with reference to the ministerial tables of the sector’s CCNL as per Art. 23 of Legislative Decree 50/2016 dated 18.04.2016
With reference to the hourly rate for the activities of ticket office operator and store operator placed on the basis of the tender of € 10.00, it is noted that this rate, to be lowered, is not congruous in reference to the ministerial tables of the CCNL for the sector as per art. 23 of Legislative Decree 50/2016 of 18.04.2016
Answer The principle that the average costs reported in the ministerial tables serve an indicative function, susceptible to deviation in relation to statistical evaluations and business analyses, is rightly transposed. It is in this key that the interpretation of the aforementioned Article 23, of Legislative Decree 50/2016 should be explained.
That said, it cannot escape the fact that the contract at issue is in fact made up of as many as eight types of activities/services:
- Guided tours 75′ groups (groups are a minimum of 18, average of 20);
- Conductor of educational activities and live shows at the Planetarium;
- Conducting guided tour/online educational activities;
- Entertainer for Parties and general entertainment activities;
- Specialized science communication activities for particular audiences and/or with specific equipment;
- Science Communicator/Bit Operator, Attendant to manning, maintaining facilities and prerecorded shows at the Planetarium;
- Reception service, planning and assistance to the booked school public (March/May);
- Ticket Office Operator / Science Store / Ticketing;
with respect to which activities 6 and 8 presumptively impact only about one-third of the entire contract.
Well, in spite of the abstract divisibility of said services, the uniqueness of the tender always requires an overall assessment of the fairness of the alleged amount, because of the foreseeable offsetting effects among the cost items under consideration. There is no doubt, therefore, that in procurement, it would be wrong to seek/verify the fairness of one cost item independently of the others. The assumed amount is, in fact, congruous if it makes the service “overall” sustainable. Specularly, an economic offer is congruous if it is “overall” reliable.
