Yes schools, both public and private, can be considered similar institutions.

Currently, the Foundation’s staff consists of 80 people

FAQ 2. Clarification is requested regarding the item “Teaching in specific training courses on workplace safety”, which type of courses are meant: exclusively Training and Information (Articles 36 and 37) or also RLS Training, Fire Fighting Training, etc.; do these courses have to be about a particular ateco code?

Reference is made in general to safety courses, without specification of the ateco code.

FAQ 3 . Regarding the call for tenders for the appointment of Prevention and Protection Service Manager, as I have to send an economic offer that will determine the award of the tender on the basis of the lowest price, I would need to know the amount you set as the basis for the tender.

The tender will be awarded in compliance with the principles of non-discrimination, equal treatment,proportionality and transparency according to the criterion of the most economically advantageous offer for the Entity based on the evaluation criteria and related scores indicated in the notice.The presumed base amount is € 32,000 plus VAT for 24 months.

RESPONSE: Fondazione IDIS-Città della Scienza is a nonprofit organization that has been working since 1987 to promote scientific culture and technological innovation with the aim of enhancing the area’s resources in the European and international context. the same is articulated in the following operational areas:Science Centre, Exit – Exhibiton Team, BIC and High FoRmation and Events and Congress Space as well as in the support areas of Administration, Personnel, Building and ICT and Communication, the composition of which is indicated on the same web page dedicated to the organizational chart.

The Science Centre at Città della Scienza is the first interactive science museum built in Italy, an educational tool for the dissemination of scientific and technological culture with the aim of stimulating in the visitor the desire to understand scientific phenomena through an innovative methodology, with guided tours, educational activities, mini campuses, and the setting up of school laboratories in the exhibition areas, outdoors and in the laboratories. EXPRESSION OF INTEREST SELECTION OF SPONSOR RESEARCHERS FOR THE 2020 REMOTE FUTURE EVENT “PLANET”

The object of the service required of sponsor researchers consists of signaling potential sponsors interested in funding the “PLANET” event, and collecting and managing contract proposals.
Interested parties should submit the following documentation:

1. Application prepared on the basis of the template in Annex A, an integral part of this expression of interest;
2. Business/professional curriculum vitae with evidence of major projects carried out (in terms of sponsors sought and funding obtained by them in the interest of third parties);
3. Copy of the certificate of registration in the register of brokers at the competent Chamber of Commerce, with evidence of the historicity of the registration.

All documentation indicated must be produced and sent by certified e-mail to idis@legalmail.it with the subject line: “SELECTION OF SPONSOR SEARCHERS FOR THE FUTURE REMOTE 2020 EVENT “PLANET.”

Question No. 1 – Question 1 With reference to art.11 of the tender specifications and taking into account the observance of the urgent and restrictive measures regarding the containment and management of the epidemiological emergency from COVID-19 and consequent activation by DAY SPA of smart working for all employees, in compliance with all local decrees and ordinances, we ask to confirm as the mode of receipt of bids, the sending of digitally signed documentation by PEC. If confirmed, please detail the breakdown of the documentation into envelopes to be attached to the bid (e.g. one PEC for each envelope or one compressed .zipper folder for each envelope, etc.).

Response: The deadline has been slipped to June 9, 2020, at 5:00 p.m., so there is no change in the delivery method

Question 2 – With reference to the economic-financial requirements, suitable bank statements are required, please confirm that these are issued by no. 2 banking institutions or authorized intermediaries

Question 3 – We are asked to confirm that, pursuant to paragraph 6 letter a) of Article 144 of Legislative Decree 50/2016, the discount on the face value of the meal voucher is to an extent not exceeding the unconditional discount towards merchants.

Question 4 – With reference to art.9.3 of the tender specifications, we ask for confirmation that it should be worded as follows: voucher value of €5.20 including VAT at 4% – (deducting VAT 4%) – percentage discount = resulting value to be borne by the Contracting Authority net of VAT.

Question 5 – With reference to art.12.8 of the Specifications, please note that the obligation of the bidder to the payment in favor of the Contracting Authority of the pecuniary sanction in case of the lack, incompleteness and any other essential irregularity of the substitutive declarations, with the exclusion of those pertaining to the technical and economic offer, is eliminated and replaced by the new paragraph 9 of art.83 of D.Lgs.50/2016 updated to the amendments provided by Law 58/2019 (converting the Growth Decree), which eliminates the obligation of the bidder to pay the financial penalty. It is requested to correct what is stated in the Specifications.

Response: A notice with the correction has been published.

Question 6 – With reference to art.13 of the specifications, we ask whether the phrase “the technical offer must be devoid of any indication (direct or indirect) of an economic nature, under penalty of exclusion from the tender” is a typo in view of the fact that the technical offer provides for the indication of the average reimbursement of meal vouchers to the contracted establishments expressed in Euros.

Response: This is a typo.

Question 7 – With reference to the demonstration of the requirements declared in the tender – art. 16 of the Specifications – we ask, with regard to the proof of specific turnover and similar services in favor of public and private entities, to accept the certificates of success issued by the entities themselves, as an alternative to receipted invoices.

Answer: It applies, similarly to receipted invoices, to the submission of certificates of good standing.

Question 8 – We are asked to confirm that in case of signing of the Power of Attorney, of the bid component documents, the copy of the Power of Attorney should be attached only to Envelope A Administrative Documents.

Answer: Yes confirmed

Question 9 – We would like to know the amount of any secretarial costs incurred (even if borne by the awarded firm), excluding stamp duty and contract registration fees;

Answer: There are no secretarial fees.

Question 10 – We would like to know the amount of any costs of publication notice and advertising (even if borne by the awarded firm) as well as any costs for related publications of tender outcomes;

Answer: There are no such expenses.

Question 11 – With reference to the activation of the network of contracted establishments and the delivery of the relevant list, please note that in Art. 7 of the Special Tender Specifications it is required to comply with the above within 20 days from the date of the conclusion of the contract or the different date indicated in the order confirmation, while in Art.9.2.1 – A) it is required to take place within 30 days from the date of the award. Please clarify which time indication should be considered.

Response In Art. 7 of the Special Tender Specifications, the 20 natural and consecutive days are understood to start from the date of signing of the contract and refer to the entire network of contracted outlets, including those outlets not yet contracted and required to “sign the agreement as well as the commitment to activate the electronic POS for the detection of fruition, within 30 days of the notice of award” (Art.9.2.1 of the specifications).
Given the length of time between the notice of award and the signing of the contract, both time indications are to be considered effective.

Question No. 1 – The economic operator wishing to participate is an associated firm with experience in the activities in question and in possession of the technical-economic requirements. The economic operator intends to avail itself of the collaboration of an Expert Engineer in Energy Management (EGE) – in accordance with CEI UNI 11339:2009 standard and an engineer with the qualification of Safety Coordinator in the design phase certified in accordance with D.Lgs. 81/2008. These technicians are not part of the professional association (associated firm) mentioned above. With reference to the possession of the minimum professional skills referred to in point D.3 of the notice, is it sufficient to declare as of now that the economic operator undertakes to involve these specialists, also indicating their personal details, or is it necessary to fill out the application form as a constituting RTP? And in the latter case, is the application filled out by the group leader or is it necessary for each member of the RTP to fill out the form?

On Friday, August 02, 2019 at 10:00 a.m. at Fondazione IDIS – Città della Scienza, in public session will be opened the economic envelopes related to the call for tenders for the assignment of the RESPONSABLE FOR PREVENTION AND PROTECTION SERVICE (ex art.17, paragraph 1, letter b, Legislative Decree No. 81/2008) for the period of 12 months from the date of contracting – CIG ZOB29128C6.

At 3 p.m., on July 25, 2019, the Commission for the Appointment of the RSPP, will meet in a confidential session to initiate the scrutiny of the applications received and verify their eligibility.

As a result of this evaluation, the applications proposed by the following applicants are eligible:

Question No. 1 – with reference to the call for proposals and specifically Article 3, in the table for scoring criteria, teaching in training courses on safety in the workplace is required. It is asked whether it is okay to attach one of the following documents: – Self-declaration of the courses conducted with their dates; – Cover sheet of the attendance register: – Minutes of training.

Acknowledgementa self-declaration of the courses taken with the relevant start and end dates is sufficient, subject to our right to ask for any further documentation.

Question No. 2 – regarding the formulation of our best offer for the above assignment, we ask for more information on the number of locations of the Fondazione Idis-Città della Scienza and the number of employees on staff.

Acknowledgment:
If by number of locations one means referring to the toponymy used by the municipality then these are two and specifically refer to house numbers 57 and 104 on Via Coroglio. Otherwise, even for the purposes of the activities to be done in relation to the call in question, the “real” headquarters of the Fondazione Idis-Città della Scienza is unique since the real estate compendium is unique.

Question No. 1 – “In the announcement it is stipulated that in Envelope A -Documents, the RCT insurance policy with a ceiling of not less than € 1,500,000.00 must be indicated. The professional interested in participating does have a professional insurance policy, but with a ceiling for a lower amount (€ 500,000.00). Therefore, it is asked whether it is possible to participate in the tender by including a commitment that in cases of award increases the maximum claim amount to the amount of € 1,500,000.00.”

Matching – The indication of the civil liability (RCT) insurance policy, the maximum amount of which, according to the notice, cannot be less than 1,500,000.00, is a condition of admissibility of the application. Fittingly, where the aspiring applicant holds a policy with a lower limit of liability than that prescribed by the notice, he/she will have to adjust it in advance.

Question No. 2 – “In the table indicating the scoring criteria, work experience as RSPP in similar institutions is required. Is it possible to know by similar institutions what is meant or at least which institutions are eligible for scoring purposes?”

Respondent – Similar institutions are defined as Public Entities, Entities controlled by them, and non-profit private law entities.

Question No. 3 – “Regarding point 3 and 4 of the table indicating the scoring criteria, about experience and teaching, is it possible to use the institution of outsourcing?”

Match – The professional requirements are personal. It is, therefore, not possible to use the institution of outsourcing to meet this claim of the notice.

Question No. 4 – “What kind of insurance coverage is required?”

AcknowledgementThe type of insurance coverage required is RCT, as the practice of RSPP does not postulate registration in a professional register for which the obligations set forth in Legislative Decree 137/2012 and subsequent implementing provisions apply.

D. 1: Please enquire whether the requirement in Article 4 point 3.1 of the public notice “qualification in accordance with the provisions of Article 3 of Ministerial Decree No. 37 of January 22, 2008 for the activities covered by the contract”, which regulates the technical-professional qualifications for the implementation of electrical installations and thermo-hydraulic installations, is not in fact a typo as it is inconsistent with the subject of the notice i.e. canteen, bar and catering services.

A. 1: With reference to question D.1, please note that the tender notice requires, at the time of bidding (phase II), the production by the bidders of an “Investment plan to improve the infrastructure and fittings of the restaurant.”, therefore, limited to the works envisaged in the plan submitted by the bidders, the latter, directly or in directly, must possess the qualifications provided for in Article 3 of Ministerial Decree No. 37 of January 22, 2008.
In summary, the requirement in Article 4 point 3.1 of the public notice is to be documented in Phase II, bid submission.

Q. 2: WHEREAS, in the PUBLIC NOTICE under point A.6 (if any) Subcontracting Declaration, reference is made to Article 18 of the tender specifications, and we do not find such specifications in the tender documents and the public notice consists of 13 Articles, is this reference a typo or what should be referred to.

A 2: It is a typo, the phrase “also in compliance with the provisions of Article 18 of these specifications” should be understood as not affixed.

D. 3: With reference to the tender notice in question, for which the undersigned wishes to express its interest in participating, it should be noted that the request, of: – bank references; – surety policy; – payment to Anac, absolutely legitimate, if the tender in question had been announced by public notice, turns out to be absolutely irregular for the “restricted” rite chosen by your esteemed Station. In fact, producing the documentation, mentioned above, at the invitation request stage, would entail an unjustified increase in expenses, for any candidates who should see their invitation request denied.

R. 3: First of all, it should be clarified that public evidence procedures also include restricted procedures, as in the case at hand (read art. 59 of DLGS 50/2016).
Coming to the substantive issues, the procedure in question is divided into 2 phases (pre-qualification and invitation to submit the technical/economic offer).
The second phase can only be accessed by those who meet the requirements of professional suitability, technical/economic capacity and technical/professional capacity, assessed during pre-qualification.
Therefore, the requests for bank references and surety policy are legitimately demanded in the present phase. About the expected ANAC payment, this complies with Resolution No. 1300del 20/12/2017.

1) There is no binding minimum amount of hours for the bid. It is clear that it will have to be plausible, i.e., justifiable according to the spaces and services required with the contract. In addition, it should be borne in mind that “Bids which, following evaluation of the technical and qualitative elements, do not achieve a minimum overall score of 30/100 compared to the maximum score attributable of 60/100, will be excluded from the tender, since they are not consistent with the minimum functional and qualitative standards expected by the Client,” as stipulated in point A of Art. 13.

It is requested to know whether, with regard to question No. 2, it is:

– Confirmed that there are 11 labor units in service in this contract or if there are modifying union agreements.

– The aforementioned units include a few workers placed on layoff.

Answer to Question No. 4

Below are the clarifications received from the current cleaning services contractor at Città della Scienza.

With reference to the request for clarification, we confirm that the transmitted data correspond to the employees who, hired following the award of the tender at the facilities Città della Scienza, have always, and exclusively, performed their work activities there.

Therefore, the same meet the requirements of Art. 4 of the industry CCNL and the specific request for information sent to us by your office.

The amount of hours accumulated by employees is equal to that of the tender awarded by the writer except for the application, as a result of the fire that occurred in March 2013, and in view of the temporary nature of the reduction in activities resulting from it, of management tools suitable for overcoming the temporary decrease in activities.

On page 31, under “Contents of Envelope B – Technical Bid,” item 5) (which is repeated in the relevant table on page 34) reads:

“Additional services not included in the tender specifications”

In reference to this, the contracting station was asked to exemplify additional services not included in the contract.

Such services, by way of example, include:

– The greater frequency of services than expected.

– The supply of toilet users’ consumables.

– Other, however always pertaining to the cleaning service.

Question No. 1

I request the following clarifications regarding the tender in question:

Please clarify: is the global turnover to be possessed quantified as €2,989,988.70 the sum of global turnover for armed and unarmed security services? Therefore please indicate what is the percentage of turnover that must be possessed by each company for the different services (armed and unarmed security). E.g.: For participation, an ATI for unarmed security services and an ATI for armed security services must be made, what are the percentages that each individual ATI must possess? Also, what percentages must the main ATI be arranged on the entirety of the procedure?

– Regarding the requirement in point (i) of the tender specifications in which at least one contract for an annual amount of € 450,000.00 is required; is this minimum contract amount required for one year only? Or must an annual contract be held for the last three fiscal years? Also, if the firm has a three-year contract amount of € 1,500,000.00 , with an average annual contract amount of € 450,000.00 is the requirement considered valid?

– Is the inspection scheduled?

– Is there provision for site passage?

Answer 1 (dated 12/22/2014)
“Global turnover” (art. 7(h) of the tender specifications) means the turnover of the bidding firm divorced from any causal specificity. Therefore, the said global turnover need not necessarily be justified for the provision of services related to this tender.

On the other hand, the “specific turnover” (art. 7, letter i) of the tender specifications) must find its causal reason in the services surveyed in the specifications, i.e., turnover of 1,494,994.35 euros, plus statutory VAT, in the last three years, cumulatively understood, for armed and unarmed concierge and security services; of this specific turnover, at least one of 450,000.00 euros must result from concierge services rendered under a single contract, in the last three years.

That being said, as stipulated in paragraph (l) of Article 7 of the tender specifications: ” Temporary consortia or ordinary consortia may participate in the tender if the group leader or one of the consortia, in relation to the requirement referred to in point h) to the first part of the requirement referred to in point i), possesses the aforementioned requirement to an extent of no less than 60%; the remaining percentage must be possessed cumulatively by the mandated company or companies or the other consortia. The requirement for the “flagship contract” (€ 450,000.00 excluding VAT) is not divisible and therefore must be possessed in full by the mandated company.

The bidder may meet the requirements under (h) and (i) above by availing itself of the requirement of another party, within the limits and in the manner provided by Article 49 of Legislative Decree No. 163/2006, as amended.

This is in keeping with the provisions of Article 261(7) of Presidential Decree 207/2010.

The inspection is not envisaged, since this is a service contract. This is without prejudice to the right of the bidding firms to visit, upon request, the compendium of “Città della Scienza” for which the service being tendered is requested.

The other questions are answered in Article 25 of the performance specifications attached to the specification (Annex 3).

Regarding the tender in question I request the following clarifications:

– Regarding point h) of the tender specifications where a global turnover of € 2,989,988.70 is required, we ask, in case of Participation in Ati by whom must the requirement be possessed and in what percentage?

Also in this regard, please clarify: is the global turnover to be possessed quantified as € 2,989,988.70 the sum of global turnover for security and concierge services or is it required for each type of service? Therefore please indicate which is the turnover to be possessed for concierge services and which for armed security services.

Also, what are the percentages for the different services to be owned by the principals and the principals of the 2 services?

– How are the minimum percentages of ATI participation distributed?

– Regarding the requirement in point (i) of the tender specifications in which at least one contract for an annual amount of € 450,000.00 is required; is this minimum contract amount required for only one year? Or must it be possessed for all three years? Also, if the firm has a three-year contract amounting to € 1,500,000.00, with an average annual contract amount of € 450,000.00 is the requirement considered valid?

– Is the inspection scheduled?

Question 2 is almost completely reflected in answer 1 remaining only a clarification with regard to the specific turnover for the concierge service for an annual amount of at least 450,000.00 euros.

Well, this amount is required for only one year and must not descend from any average.

Hence, if a company holds a three-year contract for the concierge service of € 1,500,000.00, it will have to self-certify, and subsequently prove, that it has achieved in at least one year, within the three-year period referred to in Article 7(i) of the tender specifications, the turnover of € 450,000.00.

Question 3.

With reference to the tender procedure in the subject matter, the undersigned company ………………… with registered office in ………………………. and administrative office in ………………………, makes the following request for clarification:

– With regard to the armed security service, is it possible in the tender phase to declare the subcontracting to a company in possession of all the necessary authorizations to carry out this activity and thus also fulfill the requirement of art. 7 letter i) of the Tender Specifications with regard to the part of the specific turnover related to armed security?

Answer 3. (dated 5.1.2015)

It should be clarified, before answering question No. 3, that according to Article 19 of the performance specifications, subcontracting is only allowed for the night inspection surveillance service and the evolution of the video surveillance system.

Subcontracting – a case governed by Article 118 et seq. of Legislative Decree 163/20016 – does not allow the bidding firm to make use of the prerogatives, references and/or requirements of the subcontractor. It follows that the competitor will have to prove that it possesses on its own the requirements prescribed by the notice independently of the subcontractor.

Quite different is the case of the case of the case of the availment. In this case, the competing firm will be able to rely on (avail itself of), during selection, the prerogatives of the auxiliary firm, which could also assume, in accordance with paragraph 10 of Article 49 of Legislative Decree 163/2006, the role of subcontractor within the limits of the requirements provided.

Question 4.

Hereby I am to ask you whether for participation in the tender for the award of the service of concierge and armed security and is not required under “penalty of exclusion” the possession of the License ex art. 134 TULPS?

And whether Unarmed Vigilance is to be carried out by personnel holding a decree to appointment as security guards.

Answer 4. (dated 9.1.2015)

Article 134 of Royal Decree No. 773 of June 18, 1931, as later amended, prescribes that a license from the Prefect is mandatory in order for entities or individuals to perform works of supervision or custody of movable or immovable property.

It follows that in the absence of the aforementioned license, exclusion from the competitive dialogue would occur ope legis.

For companies established in another member state of the European Union, Article 134-bis applies, according to which said companies “may establish themselves in the territory of the Italian Republic in the presence of the requirements, prerequisites and other conditions required by the law and regulations for the execution of this Consolidated Text, taking into account the fulfillments, obligations and burdens already fulfilled in the state of establishment, certified by the authority of the same state or, in the absence thereof, verified by the prefect.”

Regarding the second question, unarmed guarding can also be performed by personnel without a decree of appointment as a special security guard, this is because of the type of activities mandated by the notice.

We wanted to know if it is possible to participate in the bidding process for the contracting of armed and unarmed concierge and security services by planning to subcontract the armed security services to Vigilance Institute.

Question No. 7

In the interest of …………………., I request the kindness of having a clarification on the lex specialis of the tender in question.

It asks to produce, under penalty of exclusion, the “original receipt of the payment of the contribution to ANAC” (specifications, p. 5(m)).

By making the payment electronically, the ANAC website issues a digital payment receipt, in .pdf format, bearing the following wording:

“This receipt proves the payment of the contribution and therefore constitutes a valid document for the purpose of admission of the economic operator to participate in the indicated tender procedure.” Said receipt also contains an “ANTI-CONTRAFFIC CODE,” which guarantees the genuineness of the document.

That being said, we would like to have confirmation that, for admission to the tender, it is sufficient to produce the receipt of payment of the contribution in digital format produced by the ANAC website, also accompanied by “declaration of authenticity and copy of a valid identity document” (specifications, p. 5, lett. m) second paragraph, bottom).

Question No. 7 is positively found in view of the fact that the original of the receipt of payment of the contribution to the ANAC is allowed to the acts equated to them.

Question No. 8

Regarding the tender for armed and unarmed security and concierge, the following request for clarification is made:

– What is the hourly cost of currently hired staff?

– For the formulation of the economic offer, the following are requested: hourly rate a for armed, unarmed surveillance services , concierge and fee for the evolution of the video surveillance service, so what is the ‘amount for each individual of service on which to be based in order to make the rebate? and then how did the contracting authority formulated the base bid amount quantified as € 1,494,994.35?

The hourly cost of the personnel currently employed by the Contracting Authority can be deduced from the amounts expressed in Article 25 of the performance specifications, taking into account, for each worker, the qualification, level of classification and CCNL applied.

The supply for the evolution of the video surveillance system was estimated at 20,000.00 euros.

Because of the aforementioned data, the bidding firm, taking into account the number of hours required for each individual service by the performance specifications, will be able to deduct the costs assumed by the contracting station.

Question 9.

With reference to the above and specifically to the statements on global and specific turnovers required in Article 7 (h) and (i), we are to request which three-year period should be referred to , whether the 2011-2012-2013 or the 2012-2013-2014 three-year period.

In view of the fact that the notice under discussion was published in the EU Official Gazette and the Italian Official Gazette on Dec. 17, 2014, the statements on global and specific turnovers must relate to the fiscal years prior to the aforementioned date of publication, i.e., 2011, 2012, 2013.

Question no. 10

I turn to you for further clarification on the tender lex.

It stipulates that “The temporarily grouped entities, […], or those announcing to group […], shall indicate, both in qualitative terms and in percentage of economic incidence, the part of the service that each of the grouped or consortiumed entities will perform” (art. 6, penultimate paragraph).

Confirmation is requested that, in the case of a temporary grouping of companies of a vertical type in which the parent company undertakes to perform only the prevailing service (concierge and unarmed vigilance) and each of the mandates undertakes to perform only the secondary services (armed vigilance and evolution of the video surveillance system currently in place at the contracting station), in order to comply with the aforementioned tender provision:

(i) it is sufficient to indicate the allocation of the performance of the contract among the individual enterprises in the descriptive terms outlined above, i.e., indicating the individual services that each of the grouped companies undertakes to perform;

(ii) it is not necessary to also express the division of said allocation “in percentage of economic incidence,” once each grouping would perform exclusively one contractual service and, therefore, in percentage terms 100% of it.

Taking into account the spirit of the tender documents, which in the economic offer outline asks operators to detail the offer by “type of services” (read type of service), in the case of a vertical type of business grouping in which each grouping performs, in its entirety, a particular type of service, surveyed and distinguished in the tender documents, the percentage of incidence of the service performed should be interpreted with reference to the entire obligation, even if it is objectively complex.

Question no. 11

With regard to this tender and for the purpose of the widest participation of competitors, it submits the following questions for your attention:

  1. WHEREAS, the bidding process concerns the performance of as many as four types of services/supplies and more precisely: concierge, armed surveillance, unarmed surveillance, evolution of the video surveillance system, as for that matter confirmed by the CPV activity codes recalled in the O.J. CEE and by the bid template you have prepared Attachment 4, taking into account that the undersigned company intends to participate as mandatary (for the performance of the main activity porterage/reception and unarmed vigilance) of a grouping being formed of vertical type with mandatary Private Security Institute ex art. 134 TULPS and subcontracting to technological company I ‘evolution of the video surveillance system, asks if the technical capacity requirement required in point III 2.3 of the G.U. CEE can be met as follows:
  • Contractor mandated contracts for concierge and unarmed security services in the last three years for a total amount at least equal to the three-year base bid amount and possession of at least one concierge contract for an annual amount at least equal to € 450,000.00 excluding VAT;
  • Mandator contracts for armed security service in the last three years for a total amount at least equal to the three-year base bid amount. Or better indicate required requirement.
  1. With regard to what is stated on page 7 of Annex 3 performance specifications “the integrated service of armed surveillance – garrison First Floor Operations Room – Function. Night Vigilance ……” and more specifically to what is described for I ‘hours of coverage “from 07.00 am to 11.00 pm from Monday to Sunday” please clarify whether such “night” hours, is actually carried out from 11.00 pm to 07.00 am from Monday to Sunday;
  2. With regard to what is described on page 3 of attachment 3 performance specifications Art. 1 and more precisely “Said inspection service shall be carried out every day by a beloved security guard, for the entire compendium complex “Città della Scienza” in the time frame between 11 pm and 7 am of the following day with no. 3 passages with verification at control clock of the Exhibition Areas sea side offices and upstream side offices”, it suggests that said service is carried out by the same armed security resource that manned the second floor Operations Room. Because of what is described, we ask for clarification as to whether this interpretation is correct.

With reference to sub-question 2, indeed this is a typo in the obvious consideration that in all the tender documents when talking about night security service it is claimed to be provided from 11 p.m. to 7 a.m. the next day, every day of the week.

With reference to sub-question 3, it should be clarified that for the inspection service (of unarmed vigilance, i.e., the one to be secured from 7 a.m. to 11 p.m.) 3 passes with verification at the control clock of the Exhibition Areas, sea-side offices and upstream-side offices are expected; vice versa, for the night armed vigilance service, this will have to be secured at the second floor operations room garrison.

Question no. 12

With reference to point (i) of Article 7 – Requirements for admission to the tender – we ask you whether the requirement referring to the peak contract of € 450,000.00 on an annual basis can be fulfilled by a contract performed in the armed security services sector or, alternatively, by a single contract performed in both sectors (armed security and concierge). This is in view of the fact that the services of armed, unarmed surveillance and concierge are substantially similar in technical-operational content and by virtue of the circumstance that, to participate in the tender, it should be a company authorized with a prefectural license under Article 134 T.U.L.P.S.

Concierge and armed security services are different in nature, as is also evident from the Common Procurement Vocabulary classification.

In the follows that the person in charge of the procedure cannot deviate from the lex specialis where it requires a specific turnover for concierge services for an annual amount at least equal (€ 450,000.00 excluding VAT).

However, in view of the centrality of the “service,” possession of the requirement also occurs if it is achieved as part of an objectively complex contract, i.e. with several separate services, provided that one of them corresponds to the concierge service and that, on an annual basis, it is worth, in terms of the agreed amount, not less than 450,000.00 euros net of VAT.

Question no. 13

On p. 6 of the tender specifications it is specified that the lead agent must possess the “leading contract” requirement, otherwise the bidder can avail itself of this requirement…..in case of participation in ATI is the lead agent to avail itself or the ATI?

Since it is prescribed in the tender specifications that the economic/financial requirement related to the flagship contract must be held by the principal, it will be exclusively the said company that can exercise the right of using and not the ATI.

Question no. 14

Should the competing company have only one active bank account, it is requested to confirm the possibility pursuant to and for the purposes of Paragraph 3 of Article 41 of Legislative Decree No. 163/2006 to prove its economic and financial capacity in lieu of the second bank reference, by any other document considered suitable such as, by way of example only, the final balance sheets for the last three years.

Question no. 15

In relation to what is contained in “Art 25 – Staff Takeover Clause” found on page 15 of the Tender Specifications, that is, compliance with the economic conditions currently applied to the workers, we would like to have some clarifications in order to better define the economic offer resulting from this clause and in compliance with the par condicio among the participating companies.

The total reported in the “Annual Salary” column shown in the table within the same Art. 25 on page 15 does not appear to be totally coincident with the values of the currently applied reference contract.

We reproduce below the example for the employee shown in the first row of the said table, which is reworked here and from which would result in a significant deviation on the monthly value of the salary, the nature of which cannot be fully discerned.

The difference of €160.97 per month seems not entirely justifiable even in view of seniority steps that may have been accrued by the worker.

In addition to this, there was also included in the table on page 15 of Art. 25 of the Tender Specifications, the item “holidays/rols/former holidays” on which we would like to make some insights.

Strictly speaking, the total annual salary, given in the example as €22,303.26, would seem to encapsulate 14 months’ pay, thus ensuring that the cost of that particular worker’s salary is fully covered on an annual basis including his or her “vacation/rol/former holidays.”

Because of this, we do not understand why costs are further added for “vacation/rol/former holidays,” which so stated would almost seem to suggest that workers individually receive 16 months’ annual pay (in addition to provisions for severance pay).

The same considerations just given for the given example are repeated for all other employees and levels in the above table.

We are therefore hereby requesting more details on the quantification of the costs related to the 7 (seven) people being taken over also in relation to a per capita “cost per year” found to be anomalous with respect to the parameters found in relation to the employees engaged in the activities in question.

The difference in monthly wages found actually stems from seniority steps as well as individual values of superminimum earned.

Regarding costs related to “vacation/rol/former holidays,” it should be noted that it was deemed preferable to show the cost separately as untaken; Where vacation, rol and former holidays were fully taken the remuneration under this heading would be included in the annual remuneration.
